Catalpas Atelier News — Terms of Use

Heliopolis Creative and Culture Limited (Hong Kong) \u00b7 legal@catalpasatelier.com

These Terms of Use (“Terms”) govern your access to and use of blog.catalpasatelier.com (“this blog”), operated by Heliopolis Creative and Culture Limited (“Catalpas Atelier”, “we”, “us”). Please also read the Privacy Notice.

These Terms apply to this blog only. The Terms governing the main website, the Scribe desktop application, our subscriptions, and our other software are set out separately in the Terms of Use and EULA on our main site. Nothing in these Terms grants or modifies any license to use our software or paid services.

1. Acceptance

By accessing or browsing this blog you confirm that you have read, understood, and accepted these Terms. If you do not agree, please leave the site.

You must be of legal age to enter into a binding agreement in your jurisdiction, or have your parent or legal guardian’s permission. We may update these Terms from time to time; the updated version becomes effective when posted, and your continued use of this blog after that constitutes acceptance.

2. Scope of this blog

This blog is an informational, read-only news and articles site. It offers product news, release notes, technical write-ups, and company updates. It does not host accounts, payments, the Scribe desktop application, or other Catalpas Atelier software. Where this blog links to our main site, documentation site, or external resources, the third-party content is governed by its own terms.

We may add, remove, or change content, sections, navigation, and visual design of this blog at any time, with or without notice.

3. Permitted use

Subject to these Terms and applicable law, we grant you a personal, non-transferable, revocable, non-exclusive licence to access this blog through a standard web browser or feed reader for your personal, non-commercial reading. You may share individual links to public articles, quote short passages with attribution and a link back, and include this blog in personal bookmarks or readers.

4. Prohibited use

You agree not to:

  • access this blog in a manner that exceeds normal browsing — for example, scraping, mirroring, mass-caching, large-scale downloading, or any automated harvesting that is not a legitimate search-engine crawl complying with our robots.txt;
  • attempt to reverse-engineer, decompile, probe, scan, or bypass the security, rate limits, or access controls of this blog or its infrastructure;
  • inject malicious code, payloads, or traffic, including SQL injection, cross-site scripting, command injection, denial-of-service, or credential-stuffing attempts;
  • impersonate any person or entity, forge headers, falsify your IP or origin, or otherwise misrepresent your identity;
  • use information shown on this blog to send unsolicited communications, conduct phishing, fraud, harassment, or any unlawful activity;
  • republish, redistribute, or build derivative works from substantial portions of this blog’s content without our prior written permission;
  • use Catalpas Atelier names, logos, or trademarks in any manner likely to cause confusion or imply endorsement, partnership, or affiliation that does not exist;
  • use content from this blog as training data for machine-learning or large-language-model systems without our prior written permission, including but not limited to scraping for that purpose.

We may, at our discretion, throttle, block, log, or terminate access from any source that engages or appears to engage in any of the above, and reserve all rights to pursue legal remedies.

5. Intellectual property

Unless otherwise stated, all content on this blog — including text, images, illustrations, icons, logos, layout, code, screenshots, and the arrangement thereof — is owned by Catalpas Atelier or its licensors and is protected by copyright, trademark, and other intellectual property laws.

“Catalpas Atelier”, the Catalpas Atelier logo, “Scribe”, and related brand assets are trademarks of Catalpas Atelier (or its affiliated entities) and may not be used without permission. Trademarks of third parties referenced on this blog belong to their respective owners and are used for descriptive purposes only.

Nothing on this blog should be interpreted as granting, by implication, estoppel, or otherwise, any licence or right to use any trademark or copyrighted material except as expressly stated in Section 3.

6. No user content

This blog does not currently allow user-generated content. There are no public comments, forums, or submission forms. If you write to us by email at an address shown on this blog, you do so voluntarily; we may use the contents of that correspondence to respond to you and to improve our products and content. Please do not send us confidential information or unsolicited creative submissions.

7. Third-party links and services

This blog may link to third-party websites, products, or services. We do not control those resources and do not endorse, warrant, or assume responsibility for their content, accuracy, availability, or privacy practices. Your dealings with any third party are solely between you and that third party.

This blog uses third-party analytics and an advertising pixel as described in the Privacy Notice and the Cookie Policy. Loading of those scripts depends on your cookie consent.

8. Disclaimers

This blog and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency, security, uninterrupted operation, freedom from error, virus, or harmful component.

Information on this blog is published for general informational purposes only and is not legal, tax, financial, medical, or professional advice. Product roadmaps, feature previews, performance benchmarks, and release timelines are subject to change without notice and do not constitute a commitment. Always verify critical information with our official product pages, documentation, or release notes before relying on it.

9. Limitation of liability

To the maximum extent permitted by law, neither Catalpas Atelier nor its officers, employees, contractors, or affiliates will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your access to or use of this blog, even if advised of the possibility of such damages.

In any case, our aggregate liability arising out of or relating to this blog will not exceed one hundred United States dollars (USD 100) or the equivalent in another currency.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in those jurisdictions our liability will be limited to the smallest extent permitted by law, and nothing in these Terms excludes liability that cannot be excluded by law (such as liability for death or personal injury caused by negligence, or for fraud).

10. Indemnity

You agree to indemnify and hold harmless Catalpas Atelier from any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of applicable law, or your infringement of any third-party right in connection with your use of this blog.

11. Suspension and termination

We may, at our sole discretion, throttle, block, suspend, or terminate your access to this blog or any part of it, at any time, with or without notice, including in response to a breach of these Terms or to comply with a legal request or security incident. We may also discontinue this blog as a whole. Sections that by their nature should survive (Intellectual property, Disclaimers, Limitation of liability, Indemnity, Governing law, General) will survive termination.

12. Governing law and dispute resolution

These Terms and any non-contractual obligation arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms or this blog will be submitted to the exclusive jurisdiction of the courts of Hong Kong, except where mandatory consumer-protection laws of your place of residence give you the right to bring proceedings in your local courts and require the application of those laws.

13. General

These Terms constitute the entire agreement between you and us regarding this blog and supersede any prior understanding on this subject. If any provision is held invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms; we may assign them to an affiliate or successor in connection with a corporate transaction.
